These Terms govern your use of footsoccerpro.store and any custom manufacturing we do for you. By asking us for a quote or placing an order, you accept them.
1. Who can use this
This is a business-to-business service. By using it you confirm that you are at least 18, that you are acting for a business, and that you have authority to bind that business.
2. What we do — and what we are not
Tonton Sportswear (Shenzhen) Co., Ltd. acts as your manufacturing agent. On your instruction we identify manufacturers, negotiate terms, place orders, inspect the goods and arrange shipping. We act on your behalf and in your interest.
Two consequences follow from that, and they matter:
- We are not the manufacturer. The goods are made by third-party factories. Product quality, materials and compliance are ultimately the factory’s output; our role is to specify, check and reject on your behalf.
- This website is not a shop. There is no cart, no checkout and no online payment. Nothing on footsoccerpro.store is an offer to sell. Prices shown anywhere are indicative only; a binding price exists only in a written quote or invoice we issue to you.
3. Quotes and orders
- Quotes are based on the specification you give us and are valid for 14 days unless the quote says otherwise.
- A quote is not a contract. A contract forms when we confirm your order in writing and your deposit clears.
- If your specification changes after we quote, the price, minimum order quantity and lead time may change with it.
- Lead times are estimates. Factory schedules, raw material supply and shipping all move; we tell you as soon as we know.
- We may decline any order, including after quoting, for any lawful reason.
4. Prices, invoices and payment
All payment is by invoice. We do not accept card payments and there is no payment page on this site.
- Unless stated otherwise, prices are quoted in US dollars and exclude import duties, destination taxes and destination handling charges.
- We issue an invoice showing the goods, the amount due, our bank details and the due date. You settle it by bank transfer, or by another method we agree with you in writing.
- Standard terms: 30% deposit on order confirmation, 70% balance after you approve the inspection report and before the goods ship. Different terms may be agreed in writing for a particular order.
- Bank charges and currency conversion costs are yours unless we agree otherwise.
- Goods do not ship until the balance has cleared into our account.
- Deposits are non-refundable once production has started, because the factory has already committed materials and machine time. If we have not yet placed the order with the factory, the deposit is refundable in full.
- Payment security. Our bank details appear on our invoices and do not change without us telling you directly. If you receive a message claiming our account has changed, telephone us on +86 176 4049 4287 to verify before sending anything. We are not responsible for funds sent to an account we did not give you.
5. Samples
We recommend approving a physical sample before any production run. Samples are quoted separately and are charged at cost plus shipping; where you go on to place a production order of reasonable size, we credit the sample cost against that order.
Mass production is made to match the approved sample within normal manufacturing tolerances. Small variations in colour, dimensions and weight are inherent in manufacturing and are not defects.
6. Quality control
- Every order is inspected before it ships, at no extra charge.
- We inspect against the specification you approved. We cannot check requirements you did not tell us about.
- You receive photos and video. Where inspection is by sampling rather than piece-by-piece, we tell you the sampling level used.
- Nothing ships until you approve the inspection report.
- If the goods fail inspection we go back to the factory for rework, replacement or refund, and we tell you which before we act.
- Once you approve the report and the goods ship, you accept them as inspected — except for defects that a reasonable inspection could not have found.
7. Shipping, duties and customs
- Shipping dates are estimates. We are not liable for carrier delays, customs holds, port congestion or other events outside our control.
- Risk passes to you when the goods are handed to the carrier. We recommend you insure shipments; we can arrange insurance if you ask.
- Import duties, VAT and customs charges are yours. Rates vary by country and product and are never included in our quote.
- You are responsible for confirming that the goods may lawfully be imported into your country, and for any licence, certification, testing or labelling your market requires.
- We declare shipments accurately. We will not under-declare value or mis-describe goods, whatever reason is given. Asking us to do so will end the order.
8. Claims and returns
- Report shortages, damage or defects within 14 days of delivery, with photographs and the carton numbers concerned.
- Custom-made and made-to-order goods cannot be returned because you changed your mind.
- Where a claim is valid, our remedy is, at your choice, rework, replacement in the next production run, or a refund of the amount you paid for the affected units.
- Claims for damage in transit usually go through the carrier’s or insurer’s process. We will help you file and will provide the packing evidence you need.
9. Goods we will not source
We will not source, handle or ship:
- Counterfeit goods, replicas, or anything bearing a trademark, logo or design you do not own or hold a licence for. This includes unbranded goods that are intended to be branded later without authorisation.
- Goods that infringe any third party’s copyright, patent or design rights.
- Weapons, ammunition and their parts.
- Drugs, controlled substances and drug paraphernalia.
- Hazardous, explosive, radioactive or otherwise dangerous materials.
- Wildlife, protected species and products made from them.
- Anything prohibited by the export laws of China or the import laws of your destination country.
- Anything subject to sanctions or export controls that we are not licensed to handle.
If you ask us to source any of the above we will decline, and we may end our relationship. If you misrepresent what a product is in order to get us to source it, you are responsible for every consequence, including seizure, fines and legal action.
10. Your responsibilities
- Give us accurate specifications, quantities and delivery details.
- Own, or hold a licence for, any logo, artwork or design you ask us to have applied.
- Check that the goods may lawfully be sold in your market and meet its safety, labelling and certification rules.
- Pay duties, taxes and destination charges.
- Review inspection reports within a reasonable time. If you do not respond, storage charges may apply after 14 days.
- Pay only to the bank account shown on an invoice we issued, and verify by phone if anything looks unusual.
11. Intellectual property
This website, its text, layout, images and code belong to Tonton Sportswear (Shenzhen) Co., Ltd.. Do not copy or reuse them without permission.
Any artwork, logo or design you send us stays yours. You grant us a licence to use it only to fulfil your order. By sending it you confirm you have the right to do so and that using it will not infringe anyone else’s rights.
12. Disclaimers
We provide our service with reasonable skill and care. To the extent the law allows, we do not guarantee that the website will be uninterrupted or error-free, that any product will be fit for a purpose you did not tell us about, or that any product will sell well in your market.
Product images on this website are illustrative. Goods are supplied to the specification you approve, not to the on-site image.
13. Limitation of liability
To the extent permitted by law, our total liability for any order is limited to the amount you paid us for that order. We are not liable for indirect or consequential loss, including lost profit, lost sales, lost goodwill, or loss arising from your onward contracts.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
14. Indemnity
You agree to indemnify us against claims, losses and costs arising from your breach of these Terms, from artwork or designs you supplied, or from your sale of the goods in your market.
15. Force majeure
We are not liable for failure or delay caused by events outside our reasonable control — including natural disasters, war, epidemic, strikes, power or factory shutdowns, port congestion, carrier failure, or government action.
16. Governing law and disputes
These Terms are governed by the laws of the People’s Republic of China. The parties will first try to resolve any dispute by discussion. If that fails, the dispute will be submitted to the competent court at the place where Tonton Sportswear (Shenzhen) Co., Ltd. is registered.
17. Changes
We may update these Terms. The version in force for your order is the one published when we confirmed that order. Material changes will be flagged on this page.
